Criminological analysis of genocide drew upon analysis of corporate and state ‘crimes of the powerful’ and in turn provides a basis from which emerging problems relating to a range of environmental harms can be better understood. As with the violations of human rights discussed above, environmental problems have received relatively little criminological attention, although this gap is being closed, as the discussion below indicates. Many of the most compelling environmental concerns of the twenty-first century are not illegal and so are not criminal activities. As has been argued in relation to genocide, a narrow criminological focus on acts that break the criminal code is particularly problematic when the very states that compose law are implicated in harmful behaviour. Activities such as the extraction of minerals and timber from the Amazon might be done legitimately in accordance with Brazilian law (Solinge, 2010) but can be understood as criminal where the terms of the UN Covenant of Economic, Social and Cultural Rights are breached (Stanley, 2007). Moreover, the conduct of illegal trade in protected products also often entails attendant criminal behaviour that further compounds the damage done to local environments and those who depend directly on them. The pressure group Human Rights Watch found that illegal logging in Indonesia had a huge negative impact on the livelihoods and environment of indigenous peoples, who are already marginalized and living in poverty. Moreover, the practice of illegal logging also entails considerable corruption and the theft of income from the trade:
